XING TRAVEL Sales Terms & Conditions (California-Compliant)

These Sales Terms & Conditions apply to all travel products and services booked through XING TRAVEL LLC. Customers are advised to read these terms carefully before making any payment.


I. Contractual Relationship and Scope of Application

  • XING TRAVEL LLC acts as the organizer or agent of travel products and provides travel-related services to customers.
  • These Sales Terms & Conditions constitute a legally binding agreement between the customer and XING TRAVEL LLC.
  • Completion of payment shall be deemed as the customer having read, understood, and agreed to all terms and conditions herein.

II. Pricing, Payment, and Confirmation

  • All prices are subject to confirmation and may change due to exchange rates, fuel surcharges, taxes, or supplier policy adjustments.
  • XING TRAVEL LLC reserves the right to make reasonable price adjustments prior to confirmation and will notify customers in advance.
  • A booking is deemed confirmed only after the corresponding payment has been received and confirmed by XING TRAVEL LLC.
  • XING TRAVEL LLC ensures that all descriptions on its website and promotional materials are accurate at the time of publication. However, due to unforeseen circumstances (such as natural disasters or pandemics), itinerary order and departure times may be subject to change. Customers are responsible for regularly confirming with our travel consultants whether any such changes have occurred.
  • All prices published on the XING TRAVEL LLC website or promotional materials are listed in U.S. dollars and are based on double occupancy unless otherwise stated. Prices are valid as of the publication date of the itinerary and may change without prior notice. Prices may fluctuate due to factors including, but not limited to, fuel costs or government tax adjustments. Such fees may be included in the travel price or listed as additional charges depending on the destination. For complete package products that include airfare, once full payment has been made, the package price is guaranteed and will not change.

III. Deposit and Payment Policy:

  • Certain travel products require a deposit to confirm the booking.
  • Deposits are used to secure reservations and pay third-party supplier fees.
  • Unless otherwise required by law or expressly stated herein, deposits are generally non-refundable upon cancellation.
  • In certain circumstances, XING TRAVEL LLC may, at its discretion, convert a deposit into a Travel Credit usable within a specified future period.
  • When booking a tour, customers must provide a valid passport for each participant. The passport must be valid for at least six (6) months beyond the return date of the tour. Accepted payment methods include personal checks, wire transfers (a USD 30 wire transfer fee applies), Zelle, cash, and major credit cards (credit card payments may be subject to varying transaction fees depending on card type and issuing region). Some destinations require at least two (2) full blank passport pages for entry stamps. XING TRAVEL LLC is not responsible for any losses resulting from visa denials (including but not limited to criminal records) or customs issues at destinations or transit points.
  • Participants must be at least 12 years of age to join a tour. Minors under the age of 18 must travel with a parent or legal guardian and share accommodation with at least one adult aged 21 or older. Travelers are responsible for confirming required travel documents and ensuring they are prepared prior to departure. Failure to provide valid documents may result in denied boarding or embarkation, without compensation or refund.
  • A non-refundable prepaid deposit equal to 50% of the total tour cost is required at the time of booking.
    This deposit is used to cover advance payments to third-party suppliers, secure space, administrative costs, and other actual or reasonably anticipated losses, and constitutes mutually agreed liquidated damages.
    To the maximum extent permitted by law, this deposit is non-refundable if the customer cancels the booking.
  • The remaining balance must be paid no later than 90 days prior to the tour departure date. XING TRAVEL LLC is not responsible for any additional expenses arising from failure to make full payment by this deadline. Failure to pay on time will result in cancellation of the booking.
  • Confirmation of the booking indicates that you have acknowledged and accepted these terms.

IV. Cancellation and Refund Policy (Very Important)

1. Customer-Initiated Cancellations

  • After a booking is made, any voluntary cancellation by the customer must be submitted in writing to XING TRAVEL LLC. The effective cancellation date is the date on which XING TRAVEL LLC actually receives the written notice. If the customer or their designated representative wishes to reinstate the trip after cancellation, additional fees may apply, including but not limited to airfare reservations, hotel bookings, domestic transportation, meals, cruises, attraction tickets, administrative fees, and other related expenses.
  • If one passenger cancels from a double-occupancy booking, the remaining passenger will be charged a single-occupancy supplement. Any room type changes are subject to modification fees.
  • Cancellation fees (per person, based on the date written notice is received):
    • More than 90 days prior to departure: Deposit equal to 50% of total tour cost is non-refundable
    • 89–60 days prior to departure: 60% of total cost is non-refundable
    • 59–45 days prior to departure: 70% of total cost is non-refundable
    • 44 days prior to departure to departure date: 100% of total cost is non-refundable
  • The above cancellation fees represent a mutually agreed reasonable estimate of losses and are not intended as penalties.

2. Cancellation by XING TRAVEL LLC

  • If XING TRAVEL LLC cancels a tour due to insufficient participation, supplier issues, or other reasonable business reasons:
  • All payments made by the customer will be fully refunded; or
  • With customer consent, payments may be transferred to another equivalent product or issued as a Travel Credit.

3. Force Majeure

  • In the event that a tour cannot proceed as planned due to force majeure events, including but not limited to natural disasters, war, pandemics, government actions, or flight cancellations:
  • XING TRAVEL LLC will reasonably assist customers in communicating with relevant suppliers;
  • Refund amounts are subject to third-party supplier refund policies;
  • XING TRAVEL LLC does not guarantee full refunds but will handle such matters lawfully and reasonably.

Airfare and Checked Baggage Policies:

  • For travel packages that include airfare, XING TRAVEL LLC offers basic economy fares from multiple airlines and routes but is not responsible for the policies, schedules, or services of the selected airlines. Airlines may change schedules or flights without notice. Air tickets purchased through XING TRAVEL LLC are subject to the respective airline’s terms and conditions.
  • XING TRAVEL LLC is not responsible for penalties, delays, baggage loss, or service disruptions related to air tickets not booked through the company. XING TRAVEL LLC reserves the right to select airlines and routes for air-inclusive packages.
  • In accordance with TSA regulations, passengers must provide their full name, date of birth, and gender as shown on their passport and travel documents. XING TRAVEL LLC is not responsible for costs arising from denied boarding or ticket reissuance due to incorrect information.
  • International travel must check in at the airport at least three (3) hours prior to departure. Failure to check in on time may result in booking cancellation or seat reassignment, without recourse or compensation.
  • Airlines impose specific regulations regarding baggage weight, size, and quantity. Passengers should verify restrictions with their airline or agent. Generally, flights to Europe allow one carry-on bag and one personal item not exceeding 55 x 40 x 23 cm (21 x 15 x 9 inches). Checked baggage on European routes usually incurs additional fees, with a maximum accepted weight of 23 kg (50 lbs). Overweight baggage is subject to additional charges.
  • Liability for lost or damaged baggage is governed by the Montreal Convention; otherwise, baggage is carried at the passenger’s own risk. Travel insurance is strongly recommended. For group tours to Asia, South America, Australia, or Africa, one checked bag is generally permitted, with a maximum weight of 20 kg (44 lbs).

V. Itinerary Changes and Alternative Arrangements

  • XING TRAVEL LLC reserves the right to make reasonable adjustments to itinerary order, hotels, or transportation methods to ensure smooth completion of the tour.
  • In the event of significant changes, customers will be notified in advance.

VI. Customer Responsibilities

  • Customers must ensure that all personal information provided is true, complete, and valid.
  • Customers are responsible for verifying passport, visa, vaccination, and entry requirements.Any losses resulting from personal reasons (including document issues, tardiness, or health conditions) shall be borne by the customer.
  • Service Fees and Gratuities
  • Service fees per person (in USD/EUR/RMB) are not included in the tour package unless otherwise stated. These fees cover services including, but not limited to, tour leaders, guides, bus drivers, and cruise staff. Customers may voluntarily provide additional gratuities to staff who deliver exceptional service during the trip.
  • Customers are responsible for ensuring they are in good health and fit for travel, carrying sufficient necessary medications, and keeping such medications in their carry-on luggage. Customers should consult appropriate medical authorities prior to departure regarding preventive medical measures for destination countries or cities.
  • XING TRAVEL LLC is not responsible for loss of personal property, injury, accidents, death, physical or mental distress, discomfort, disappointment, or depression resulting from unforeseeable events, including but not limited to illness, theft, trade disputes, mechanical failures, quarantine, war, government restrictions, civil unrest, adverse weather conditions, road closures or poor maintenance, or other factors reasonably beyond the control of XING TRAVEL LLC or its service providers.
  • XING TRAVEL LLC reserves the right to change airlines, tour arrangements, and hotels (of the same category). Booking through XING TRAVEL LLC indicates that you have read and agreed to these Terms & Conditions.

VII. Limitation of Liability and Disclaimer

  • XING TRAVEL LLC does not directly provide airline, hotel, transportation, or attraction services; such services are provided by independent third-party suppliers.
  • To the maximum extent permitted by law, XING TRAVEL LLC shall not be liable for losses arising from:
  • Acts or omissions of independent third-party suppliers;
  • Force majeure events;
  • The customer’s own acts or negligence.
  • Nothing in these terms excludes or limits liability that cannot be excluded under California law, including but not limited to liability for personal injury or property damage caused by gross negligence or willful misconduct.
  • Complaints: If any issues arise during the trip, customers should promptly contact a XING TRAVEL LLC representative for immediate assistance. If the issue is not resolved on-site, customers should submit a written statement within 30 days after completion of the trip. Failure to do so may affect investigation or resolution options but does not affect non-waivable legal rights.

VIII. Insurance Recommendation

  • XING TRAVEL LLC strongly recommends that customers purchase travel insurance covering medical expenses, cancellation, baggage, and trip interruption.

IX. Governing Law and Dispute Resolution

  • 1. These Sales Terms & Conditions and any disputes arising therefrom shall be governed by the laws of the State of California, USA.
  • 2. The parties agree that any disputes shall be submitted to courts with proper jurisdiction in the State of California.

X. Amendments to Terms

  • XING TRAVEL LLC reserves the right to update or amend these Sales Terms & Conditions within the limits permitted by law. Updated terms shall apply to bookings made after the effective date of such changes.
  • The agreement between the customer and XING TRAVEL LLC is conditioned upon acceptance, without modification, of the terms, conditions, and notices contained herein. You hereby agree to all such terms, conditions, and notices.
